2. Orders
When you place an order on our Website, you will receive an email confirmation.
This confirmation means we have received your order, but it does not guarantee acceptance. We reserve the right to cancel an order if the product is unavailable, payment fails, or fraud is suspected.
By placing an order, you confirm you are at least 18 years old, or you have parental/guardian permission.
3. Prices & Payments
All prices are listed in euros (EUR) and include VAT where applicable.
Payment is accepted via Stripe (credit/debit cards, Apple Pay).
Your order is only shipped once payment is successfully received.
4. Shipping & Delivery
We ship orders using POST Luxembourg, DHL, DPD, or UPS depending on the destination and order size.
Delivery times vary by country and are displayed at checkout. Once shipped, you will receive an email with a tracking number and estimated delivery time.

5. Returns & Refunds
In accordance with the EU Consumer Rights Directive (2011/83/EU), you have the right to return your order within 14 days of receiving it, without giving any reason.
To exercise this right, contact us at info@neverbeenshop.com within the 14-day period. We will provide instructions on how to return your items.
Returned products must be unused, in original condition, and with tags and packaging intact.
Unless the product is faulty or incorrect, the customer is responsible for the cost of return shipping.
Refunds are processed via the original payment method within 14 days of receiving the returned goods.

6. Faulty or Wrong Items
If you receive an item that is faulty, defective, damaged, or not as described, please contact us immediately at info@neverbeenshop.com.
In these cases, we will replace the item or issue a full refund, and we will cover the cost of return shipping.
“Faulty” means items damaged during delivery, with manufacturing defects, or incorrect products sent. It does not include normal wear and tear, or damage caused by misuse.
7. Intellectual Property
All intellectual property rights in the Never Been brand, including the name, logos, product designs, artworks, graphics, photographs, and website content, are owned by Never Been. These materials are protected under copyright, trademark, and design laws.
You may not copy, reproduce, distribute, publish, modify, or commercially exploit any part of our brand, products, or content without our prior written permission.
Any unauthorized use of our intellectual property may result in civil and/or criminal legal action. We actively monitor and enforce our rights across all sales channels and online platforms.
8. Limitation of Liability
We are not responsible for delays or failures caused by events beyond our control (force majeure).
To the maximum extent permitted by law, we are not liable for indirect or consequential damages.
Your statutory consumer rights remain unaffected.
9. Governing Law
These Terms & Conditions are governed by the laws of Luxembourg.
Any disputes will be handled by the competent courts of Luxembourg, unless mandatory consumer protection law grants you the right to bring proceedings in your country of residence.
